Terms & Conditions

These Terms and Conditions ("Terms") govern the provision of vehicle brokerage services by Ballard Marque Broker Sales, a sole trader business operated by Paul Ballard ("we", "us", "our"). By engaging our services, you ("the Client") agree to be bound by these Terms.

2. Financial Services Authorisation

Ballard Marque Broker Sales  , is an Appointed Representative of Hart Contracts Limited, which is authorised and regulated by the Financial Conduct Authority (FCA No. 808982). Hart Contracts Limited is permitted to carry on regulated activities such as credit broking and introductions to finance on behalf of its Appointed Representatives. Ballard Marque Broker Sales  is authorised and regulated by the Financial Conduct Authority as an Appointed Representative (FCA No. 1042037). 3. Services Offered

We provide the following services:

• Vehicle sourcing and procurement services, specialising in BMW new and approved used vehicles

• Access to vehicles from other manufacturers

• Finance and insurance arrangement services

• Part-exchange valuation services

 

4. Service Process

4.1 Initial Consultation

We offer a free 20-minute no-obligation consultation which broadly explains how we operate and how we deal with the supplying retailer on your behalf. This consultation does not constitute a commitment to proceed with our services.

4.2 Detailed Assessment Service

Following the initial consultation, if you choose to proceed, we provide a comprehensive detailed assessment service which includes:

• Complete requirements analysis and vehicle specification review

• Finance arrangement consultation (where applicable)

• Part-exchange valuation assessment (where applicable)

• Market research and supplier identification

 

4.3 Vehicle Sourcing and Deal Completion

Upon completion of the detailed assessment, we commence vehicle sourcing and negotiate terms with supplying retailers on your behalf. "Deal completion" occurs when you sign the vehicle purchase contract with the supplying retailer, regardless of vehicle delivery date.

Typical timeframe for sourcing a vehicle is within 7 days, depending on model and specification requirements.

5. Fees and Payment Terms

5.1 Fee Structure

• Initial Consultation: Free 20-minute no-obligation consultation

• Detailed Assessment Fee: £99 (covers comprehensive requirements analysis, vehicle specification review, finance arrangement consultation, and part-exchange valuation)

• Completion Fee: From £499 to maximum £2,000 (dependent on contract value/savings achieved) - exact amount confirmed in writing during detailed assessment

 

5.2 Payment Terms

• The detailed assessment fee of £99 is payable by bank transfer before commencement of the detailed assessment service

• The completion fee is payable by bank transfer upon deal completion (when you sign the vehicle purchase contract with the supplying retailer)

• Any deposit required for vehicle ordering will be payable directly to the supplying retailer

• All payments to BM Broker Sales must be made by bank transfer to: [BANK DETAILS REQUIRED]

 

5.3 Consumer Rights and Refund Policy

Under the Consumer Contracts Regulations 2013, you have the right to cancel this agreement within 14 days without giving any reason. However, by requesting the detailed assessment service, you are expressly requesting us to begin performance during the cancellation period and acknowledge liability for payment proportionate to services provided during that period.

The detailed assessment fee is refundable only:

• If you cancel within the 14-day period before requesting the detailed assessment service to commence

• If we are unable to provide the detailed assessment service due to our error or omission

The completion fee is refundable if:

• We cannot source the vehicle meeting your requirements

• You withdraw before deal completion (vehicle contract signature)

• The supplying retailer cancels the order

 

6. Vehicle Orders and Contracts

• The supplying retailer holds the direct contract for any vehicle ordered

• We act as intermediary between you and the supplying retailer but are not party to the vehicle sale contract

• All warranty, delivery, and after-sales obligations remain with the supplying retailer

• You will need to refer to the supplying retailer's terms and conditions regarding vehicle cancellation policies and any associated fees

 

7. Part-Exchange Services

• We provide initial part-exchange valuations as part of our detailed assessment service

• All part-exchange valuations are estimates only and are subject to physical inspection and final valuation by the supplying retailer

• The supplying retailer retains the right to adjust part-exchange values following vehicle inspection

• If your vehicle purchase does not proceed to completion for any reason, no part-exchange transaction will occur

 

8. Limitation of Liability

• All liability for vehicle condition, defects, warranty claims, and after-sales service remains with the supplying retailer

• We are not responsible for manufacturer delays, supply chain issues, or changes to vehicle specifications

• We are not responsible for finance approval decisions made by lending institutions

• Our total liability under these Terms is limited to the total amount of fees paid by you for our services

• We exclude all liability for indirect, consequential, special, or incidental losses, including but not limited to loss of profits, business interruption, or alternative accommodation costs

• Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation

 

9. Data Protection

We process your personal data in accordance with UK data protection legislation and our Privacy Policy, which can be found at www.bmbrokersales.com/privacy-policy. By engaging our services, you consent to the processing of your personal data for the purposes of providing our brokerage services, including sharing relevant information with supplying retailers and finance providers.

10. Professional Indemnity Insurance

Professional indemnity insurance is maintained by our principal, Hart Contracts Limited, under whose regulatory umbrella we operate as an Appointed Representative. Details are available upon request.

 

11. Complaints Procedure

11.1 How to Complain

• We are committed to providing the highest standard of service. If you have a complaint about any aspect of our service, full details of our complaints procedure can be found at www.bmbrokersales.com/complaints-procedure

• If you wish to raise a complaint, please contact us in the first instance at info@bmbrokersales.com. We will acknowledge receipt within 3 working days and aim to provide a full written response within 8 weeks.

 

12. Intellectual Property

All intellectual property rights in our website, marketing materials, and documentation remain our property. You may not reproduce, distribute, or commercialise any of our intellectual property without prior written permission.

 

13. Confidentiality

We will treat all information provided by you as confidential and will not disclose it to third parties except as necessary to provide our services (including sharing with supplying retailers and finance providers) or as required by law. This obligation continues after termination of our agreement.

 

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, government restrictions, pandemics, strikes, cyber attacks, or supply chain disruptions.

15. Variation of Terms

We may update these Terms from time to time. Material changes will be communicated to existing clients via email. Continued use of our services after notification constitutes acceptance of the updated Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreement, constitute the entire agreement between us and supersede any prior agreements or representations. No changes to these Terms will be effective unless agreed in writing.

17. Governing Law and Jurisdiction

These Terms are governed by English law. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the English courts, unless you are a consumer resident in Scotland or Northern Ireland, in which case proceedings may be brought in the courts of your home jurisdiction.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
